North Adams Housing Authority – Free WiFi Terms of Service (TOS)

Effective Date: 03/31/2026 (subject to change)

The North Adams Housing Authority (NAHA) provides complimentary wireless internet access (“Service”) to tenants as a convenience. By accessing or using this Service, you (“User”) agree to the following Terms of Service. If you do not agree, you must discontinue use immediately.

1. No Warranty / Service Provided “As Is”

The Service is provided “AS IS,” “AS AVAILABLE,” and without any warranty of any kind, whether express or implied. NAHA does not guarantee:

  • Continuous or uninterrupted connectivity
  • Any specific speed, bandwidth, or performance
  • Compatibility with any device
  • Security, privacy, or protection from malicious activity

Users assume all risks associated with using the Service.

2. No Liability

To the fullest extent permitted by law, NAHA is not liable for any damages, losses, claims, or expenses arising from:

  • Use or inability to use the Service
  • Security breaches, malware, or unauthorized access
  • Loss of data, privacy, or device damage
  • Illegal, harmful, or inappropriate online activity by Users
  • Third-party actions, content, or services accessed through the network

Users are solely responsible for their online behavior and for securing their own devices.

3. Acceptable Use Requirements

Users agree NOT to use the Service for any unlawful, abusive, or disruptive activity, including but not limited to:

  • Violating federal, state, or local laws
  • Copyright infringement (e.g., illegal downloading or file sharing)
  • Harassment, threats, or harmful communications
  • Attempting to access unauthorized systems or accounts
  • Hosting servers, running network intensive applications, or interfering with network performance
  • Distributing malware, spam, or malicious content
  • Any activity that jeopardizes the security, stability, or performance of the network

NAHA may monitor network traffic for security and operational purposes.

4. No Expectation of Privacy

Users acknowledge that:

  • The network may not always be encrypted, please use due diligence and avoid transmitting sensitive personal, financial, or confidential information over the Service if proper encryption cannot be verified.
  • Traffic may be monitored for security, maintenance, and policy enforcement
  • NAHA does not guarantee confidentiality of any communication

5. Termination of Access

NAHA reserves the right to suspend or terminate a User’s access to the Service at any time, without notice, for any reason, including but not limited to:

  • Abuse of the Service or violation of this TOS
  • Illegal or disruptive online activity
  • Actions that threaten network security or performance
  • Excessive bandwidth consumption
  • Non-payment of rent or violation of lease terms
  • Operational, maintenance, or administrative needs
  • Any reason deemed necessary to protect NAHA, its tenants, or its infrastructure

Access to the Service is a privilege, not a right or a guaranteed housing service.

6. Changes to the Service or Terms

NAHA may modify, limit, suspend, or discontinue the Service at any time. NAHA may also update these Terms of Service without prior notice. Continued use of the Service constitutes acceptance of any changes.

7. User Responsibility

Users are responsible for:

  • Securing their own devices (antivirus, updates, firewalls)
  • Monitoring the online activity of minors in their household
  • Ensuring compliance with all applicable laws and these Terms

8. Indemnification

Users agree to indemnify and hold harmless NAHA, its employees, agents, and affiliates from any claims, damages, liabilities, or expenses arising from:

  • Their use of the Service
  • Violations of this TOS
  • Illegal or harmful online activity conducted through their devices

9. No Guarantee of Availability

The Service may be unavailable due to:

  • Maintenance
  • Outages
  • Technical issues
  • Upgrades
  • Administrative decisions

NAHA is not obligated to restore service within any specific timeframe.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts.
